What
is a Homestead?
The
New Hampshire homestead law makes real property and mobile homes
that are the principal dwelling of any person exempt from any judicial
attachment or levy, including through bankruptcy, up to the amount
of $50,000. This exemption also protects the non-owner spouse of
the property owner if title to the property is held in the name
of only one spouse. Any waiver of this homestead exemption by the
non-owner spouse must be signed and acknowledged before a Justice
of the Peace or a Notary Public.
